Yari ka Sen. Trillanes, your Foreign Bank Accounts Not Protected by RA 1405

Pres. Duterte on Saturday claimed Trillanes has offshore bank accounts, saying: "I'm coming out with Trillanes' bank deposits all over. So I am giving you in a few days the number of deposits he has with Chinese joint accounts."

In denying Duterte's allegations, Trillanes said that on Monday, September 11, he will sign a waiver for all the alleged bank accounts cited on FB posts of President Duterte's media allies.

"Pipirma ako kaagad ng waiver para sa AMLC [Anti-Money Laundering Council] at para sa Ombudsman, at iimbitahan ko ang fact-finding team ng Obudsman at kung may media na sasama sa bangko na na-identify nila dyan ... at magwo-walk in kami at doon mismo makita kung ano talaga ang laman ng mga account na 'yan."

I am willing to go that far para malinis ko ang pangalan ko at para ma-prove ko na sinungaling itong si Duterte at ginagamit niya ang kapangyarihan ng gobyerno para manira at mang-harass ng political opposition.

Kaso nga lang di ata alam ni Trillanes ang BANK SECRECY (RA 1405) DOESN'T COVER FOREIGN ACCOUNTS. Republic Act 1405, more commonly known as the Bank Secrecy Law, details prohibitions in Section 2, part of which states [http://bit.ly/2xVIS4N]:

"All deposits... in the Philippines including investments in bonds issued by the Government of the Philippines, its political subdivisions and its instrumentalities, are hereby considered as of an absolutely confidential nature..."

Yes, a key element there is the phrase "in the Philippines".

In short, you can disclose in the Philippines information about any foreign bank account without fear of being penalized under RA 1405, for the simple reason that the accounts are not in the Philippines.

Note that you may still be penalized under foreign laws in their respective jurisdictions, if and when you visit that country and somebody sues you, but that's another story.

However, in as far as Senator Antonio "Sonny" Trillanes IV's alleged foreign bank accounts, Trillanes's isn't protected by RA 1405. Kaya pwedeng pabuksan ang mga bank account ni Trillanes abroad.

Ito na nga ang sinasabi ni Vice Mayor Pulong Duterte na "Law of Karma" kay Trillanes dahil sa pagsisinungaling nito. Kaya siguro sinabi ni Polong ito na may Karma...dahil may hawak na pala silang katibayan...kaabang-abang ang mga susunod na kabanata.

Minsan ng sinabi ni Sen. Trillanes na naniniwala daw sya sa karma, kaya ayan nahhh.....nagigisa na sya sa sarili nyang mantika!!! Lahat paninira at panloloko ni trililing ay bumabalik na sa kanya..umpisa pa lang iyan.

Hindi naisip ng mga consultant ni Trillanes ang mga magiging scenario. Trying hard kasi ito si Trililing eh kalabanin ba naman un totoo may alam sa pasikot sikot ng batas.
